What happens in mediation?

As the mediator, Ashley will welcome the participants and explain the mediation process, her role in the process, and the rules of mediation. This usually happens jointly. The participants will then caucus separately to present the issues they seek to resolve, their goals for mediation, and begin the process of negotiating toward a mutual resolution. The mediator will attempt to bring opposing interests together by defining the important issues and eliminating obstacles while moderating and guiding the process to prevent fights and avoid a breakdown of resolution efforts. During this time, the mediator will ask each party questions as well; however, the mediator cannot tell each other side what the other has said and must keep all conversations confidential, unless otherwise agreed. If the parties reach an agreement and sign it, it can be enforceable as a binding legal contract.
